STATUS OF THE COURT
The Court of Arbitration at the Polish Confederation of Private Employers is a separate and fully independent entity having its own Governing Bodies.
The disputes submitted before the Court are of economic nature. They are disputes that have arisen between both domestic and international entities. Till now, 25 per cent of cases concerned the common market issues. Additionally, it is possible to apply foreign law dispute, and the proceedings may be conducted in foreign languages. Therefore, it was only major practitioners having extensive experience in handling international matters that could be nominated as the Arbitrators of the Court.
The number of cases submitted before the Court as well as the number of issued awards are growing. Often the cases end with the parties’ conclusion of an agreement. The average time of awaiting issuance of the award is 9 months. The cases which are resolved faster are usually ones conducted by a sole arbitrator. This is a possibility provided for by the Rules with the view to allow the parties fast-track dispute resolution procedure. The issuance of the award lasts longer wherea party to the dispute is an international subject.
In order to improve the entrepreneurs’ knowledge about arbitration, the Court provides the project “Promotion of amicable methods of commercial dispute resolution” co-financed by the European Social Fund. Dr Beata Gessel-Kalinowska vel Kalisz, an arbitrator and Vice President of the Court, is the coordinator of the project. Its aim is not only to promote arbitration as a method of dispute resolution among Polish entrepreneurs, but also to promote Polish arbitration forum among international subjects conducting their businesses in Poland.
